Giving birth in Argentina
Citizenship for the child from birth — and an honest account of what that means for the parents
Birthright citizenship in Argentina is unconditional: a child is a citizen from birth, passport is issued within a month. This is true, and it’s why people come here. The other half of the truth: from 2025, having a child does NOT shorten the parents’ two years and does NOT automatically grant them permanent residence — income and criminal record are reviewed. We handle both: the child’s documents and the parents’ status.
Who it suits. For couples planning to give birth in Argentina and intending to stay afterwards.
What is included
- We find the clinic and doctor, and review contracts before signing
- We accompany you at appointments and during delivery, including interpretation
- We obtain a birth certificate, DNI, and passport for the child
- We file for parents under the family reunification basis and start the clock
- We run the two-year counter and prove it: we make sure the clock is genuinely ticking — precaria and tourist 90-day stays do not count toward it, and departures reset the clock continuity
- We calculate the full budget in advance and show you which part of it is not our fee
What the package does not include
Paid separately and directly, with no markup from us.
- Shorter timeline for parents: having a child does not reduce the two years or grant Permanent residence is granted automatically — income and criminal record are checked, along with the requirements of the decree hallenged in courts
- Healthcare: private clinic 1,500–2,500 $, C-section 3,000–6,500 $, contract with clinic and with doctor around 2,000 $ each, tests around 500 $
- Free childbirth at a public hospital: Decree 366/2025 permitted charging non-residents, and some provinces have already introduced fees — this can no longer be counted on
- Housing for three months: around $3,000, paid to the landlord
- A realistic three-month family budget is $15,000–18,000, and our fee is one-tenth of that
In May 2025, decree 366/2025 transferred citizenship cases from the courts and handed them Migraciones, and at the same time tightened the residency clock: two years of legal residence in a row. A precaria, under which a person lives while their application is being reviewed eir case — that period is not counted. The tourist 90 days are not counted either. Departures break continuity. We have tracked this counter from day one and we gather evidence in advance: rental agreement, utility bills, bank records, entry stamps o entries and exits — because the decision rests with the authorities reviewing the paperwork, not word by word. Parts of the decree are being challenged in courts, and we work in a way that your stay was provable regardless of the outcome.
In May 2025, decree 366/2025 transferred citizenship cases from the courts to Migraciones, and at the same time tightened the residency clock: two consecutive years of legal residence are required. Precaria, under which a person lives while their case is being reviewed; during this period does not count. Nor do tourist 90-day stays. We track the count from day one and gather evidence in advance, because the authority decides on the basis of documents, not words.
Decree 366/2025 is being contested: one first-instance ruling and two appellate courts declared parts of the decree unconstitutional — primarily regarding restrictions for parents of Argentine-born children. Migraciones practice in such cases follows the decree. That’s why we make no promises of ’everything as before’ or ’the door is closed’ — we simply work the way so that your period of stay is provable under any outcome.
