Russian-speaking lawyers in Marbella
An hour with a lawyer in Marbella costs €120–300; full residence permit support — €2,000–4,000; a property transaction — from €2,000 or around 1% of the amount. Verify a licence by the colegiado number at the Marbella delegation of the Colegio de Abogados de Málaga. If your income is below €16,800 per year, a courtroom lawyer may be free of charge under justicia gratuita.
When you really do need a lawyer in Marbella
Marbella and the Costa del Sol represent a premium real estate market where transaction values are high and the risks are specific. For Russian speakers, a lawyer is needed above all for buying luxury property, legalising villas, obtaining a residence permit, and appealing rejections. Important: the Golden Visa was abolished on 3 April 2025 — buying property no longer grants a residence permit, and anyone offering you a ’golden visa’ today is selling a service that no longer exists.
Price guide: one hour with a lawyer in Marbella — €120–300, transaction support — from €2,000 or approximately 1% of the deal value, appeal period for a refusal (recurso) — 1 month.

What matters specifically for Russian speakers from the CIS
This is what Spanish websites will never tell you, yet it determines everything:
- Source of funds (origin of funds). When buying property, the bank and notary will ask where the money comes from. Funds from Russia face serious scrutiny — a transparent chain of documentation is required, and banks frequently refuse. A lawyer helps build the evidentiary file and process the payment legally.
- How to move money. Direct SWIFT transfers from Russia are restricted — use third countries, USDT, or an international transfer service. Plan this out before paying a deposit.
- CIS documents. Criminal record certificates, diplomas, and civil records from Russia, Belarus, or Ukraine are only accepted with an apostille and a sworn translation (traductor jurado) — obtainable remotely.
- **Russian / Belarusian passport. Renewing a foreign passport from abroad is difficult, so a residence permit is a way to legalise your stay and live without stress — not just a ’nice bonus.’
Real estate lawyer in Marbella: a villa without a licence — the main risk on the Costa del Sol
A trap unique to the region: many villas were built or extended without a license and have not been legalized. They can be regularized through the AFO/DAFO procedure (Declaración de Asimilado a Fuera de Ordenación) — without it, the property is difficult to sell, insure, or connect to utilities. A lawyer checks before the transaction:
- legal status of the building and whether an AFO/DAFO certificate exists, plus any unauthorized extensions or pools;
- nota simple — owner, mortgages, liens;
- a bank guarantee covering payments on off-plan new developments;
- outstanding IBI debt and urbanización fees.
Tax advantage: Andalusia has abolished the wealth tax (impuesto de patrimonio) and maintains ITP at 7% — a magnet for affluent buyers. Budget 10–12% on top of the purchase price.

Immigration lawyer in Marbella: residence permits after the Golden Visa abolition
Marbella was historically one of the main addresses for the Golden Visa — but the programme has been abolished (last filing date: 3 April 2025). Today a lawyer handles the entire process of:
- Residence permit (no lucrativa, digital nomad visa), renewals, adding family members; renewal of previously issued Golden Visas;
- Digital Nomad Visa (income from €2,849/month);
- structuring the purchase (as an individual or a company) with tax implications in mind.
A refusal can be appealed via recurso de reposición within one month.
Residence permit grounds are covered at the country level, not by city — we have compiled the requirements, amounts, and document checklists separately: Residence permit in Spain: all grounds, Non-lucrative residence permit (no lucrativa), family reunification, and student visa. This page covers only what is specific to Marbella: the practices of the local Oficina de Extranjería, processing times, and local prices.

Free legal aid in Marbella: who qualifies for justicia gratuita
Before you pay, check whether you are entitled to a free lawyer. The right to justicia gratuita is established by Ley 1/1996, and the threshold is calculated against the IPREM, which in 2026 is frozen at €600/month (€8,400/year in 14 payments). The gross income of the entire household is assessed:
- **up to €16,800/year — single person (2 IPREM);
- **up to €21,000/year — family of fewer than 4 (2.5 IPREM);
- **up to €25,200/year — family of 4 or more, or large families (3 IPREM).
The key point almost never mentioned in Russian-language sources: the law uses the phrase «los extranjeros que se encuentren en España» — ’foreigners present in Spain.’ There is no requirement of legal residency: without a residence permit, with an expired visa, or in the middle of a legalization process — the right is preserved as long as income is below the threshold.
What it covers: a lawyer and procurador in court, court fees, expert reports, publications, plus an 80% discount on notary and registry fees.
What it does NOT cover: the residence permit application itself — that is an administrative procedure, not a court matter. However, judicial appeal of a refusal (recurso contencioso-administrativo) is a court matter and is covered by justicia gratuita. The law separately lists cases involving denial of entry, return, deportation, and asylum — but income is still assessed there too; «free for everyone» does not exist.
**Where to go: Servicio de Orientación Jurídica (SOJ) at the bar association — in Marbella that is the Colegio de Abogados de Málaga delegation in Marbella (C/ Salvador Rueda, 3) — Marbella has no bar association of its own.
Let’s be honest: most people reading this page earn more than €16,800 a year and will not qualify for justicia gratuita. Still, it’s worth knowing the threshold — there’s no reason to pay for something you’re entitled to for free.
A Russian-speaking lawyer in Marbella: how to choose and avoid pitfalls
- verify the colegiado number with the Ilustre Colegio de Abogados de Málaga (ICAMÁLAGA, icamalaga.es) — Marbella falls under the Málaga bar association;
- for luxury properties and villas, hire a lawyer with AFO/DAFO and Costa del Sol experience;
- work out the ownership structure (individual vs. company) with a lawyer and tax advisor before purchasing;
- set out the scope and fees in a contract (hoja de encargo) before payment.

Frequently asked questions
How much does a Russian-speaking lawyer cost in Marbella?
Hourly rate — €120–300. Full residence permit support — €2,000–4,000 plus government fees. Real estate transaction support — from €2,000 or around 1% of the deal value. Initial consultation with SVOY lawyers — free.
How to verify that a lawyer in Marbella is legitimate?
Every practicing lawyer in Spain has a colegiado number. Verify it with the Colegio de Abogados de Málaga delegation in Marbella (the city has no bar association of its own). And confirm the scope of work and price in a written agreement (hoja de encargo) before paying — without it, there will be nothing to dispute.
What to do if your Spanish residence permit is denied?
Deadlines run from the date of notification. Recurso de reposición — 1 month, filed with the same authority, and it is optional. Recurso contencioso-administrativo — 2 months, filed in court, and can be submitted immediately. If the refusal is procedural (a missing document, an expired certificate), it is often faster and cheaper to reapply from scratch.
Who is entitled to a free lawyer in Spain?
The right to justicia gratuita (Ley 1/1996) applies when annual income does not exceed €16,800 for a single person, €21,000 for a family of fewer than 4, and €25,200 for a family of 4 or more — that is 2 / 2.5 / 3 IPREM, and the IPREM is frozen at €600 per month in 2026. The key point: the law refers to ’foreigners present in Spain’ and does not require legal status. It covers court proceedings, but not residence permit applications.
Do you need a lawyer when buying property in Marbella?
Legally, no — only a notary is required. But on the Costa del Sol the main risk is an unlicensed villa: a lawyer checks the nota simple, the legality of the construction and any extensions, and outstanding IBI and community fees. On premium properties, the cost of a mistake runs into hundreds of thousands of euros.
