Documents and certificates in Madrid
Getting legal status in Madrid: which documents and statuses Russian speakers need and where to begin.
Why legalization in Madrid doesn’t start with a visa
Relocating to Madrid is not simply a change of address. It means building a legal identity in a new country — as a tax resident, a tenant, an employer, or a student. And it all begins with two documents: NIE and Padrón. Without them you cannot open a bank account, sign a lease, register a company, or enrol a child in school. Understanding the logic of Spanish bureaucracy saves months of time and hundreds of euros.

NIE, TIE and Padrón: what they are and how to get them in the right order
NIE (Número de Identificación de Extranjero) is an individual identification number for foreign nationals — physically, it may be nothing more than a stamped sheet of paper. TIE (Tarjeta de Identidad de Extranjero) is a biometric plastic card issued when a residence permit is granted. These are two different documents, and confusing them is one of the most common mistakes.
Padrón — municipal address registration at the district office (Junta Municipal del Distrito). Without a Padrón you cannot obtain a TIE, register with a doctor under the public health system, or apply for most residence permits. Processing time: 1–5 working days, with a rental agreement or written permission from the property owner.
Steps to take for most schemes:
- Obtain a Padrón (an address is required)
- Obtain an NIE (through the consulate before entry, or in Spain — at a police comisaría or through Extranjería)
- Apply for a specific residence permit type and obtain a TIE
Types of residence permit for Russian speakers in Madrid
Spain offers several viable pathways for relocation. In 2026, the most popular among Russian speakers are:
| Residence permit type | Best for | Processing time | Key requirements |
|---|---|---|---|
| Digital Nomad Visa | Remote workers, freelancers | 20–45 working days | Income from €2,849/month (200% SMI, 2026 threshold), contract/clients outside Spain |
| Residencia No Lucrativa | Financially independent applicants | 1–3 months | Proof of income ~€2,400/month per person + insurance |
| Cuenta Propia (sole trader/autónomo) | Entrepreneurs | 1–3 months | Business plan, registration of activity in Spain |
| Reagrupación Familiar | Residents’ families | 2–4 months | Sponsor must be a current Spanish resident |
| Student visa | Students, language courses | 2–6 weeks | Enrollment at an accredited institution |
An insider detail: No Lucrativa is often underestimated as a ’passive’ route — but it is precisely the right fit for those living on income from overseas property or dividends. Bear in mind that it does not permit work in Spain, something many applicants overlook when applying.
Digital Nomad Visa was introduced in 2023 and is still processed inconsistently: the UGE (Unidad de Grandes Empresas) in Madrid works faster than consular channels — an important factor to consider when choosing where to apply.

Documents: apostille, notary, jurado
All Russian documents for use in Spain must go through a mandatory chain:
- Apostille — affixed in Russia to official documents (diplomas, birth certificates, marriage certificates).
- Sworn translator (traductor-intérprete jurado) — only specialists accredited by Spain’s Ministry of Foreign Affairs qualify. The list is available on the MAEC website. Cost per page: €30–60, depending on complexity.
- Notarial certification — in certain cases, an additional notarial legalisation of the translation by a Spanish notary is required.
A hidden cost people often overlook: the criminal record clearance certificate is valid for 3 months from the date of apostille for most residence permits. If the document was prepared in advance and the application was delayed, you will need to obtain it again.
Residence permit filing fees (tasa) are paid via form modelo 790 código 052 at a bank or online. The amount varies by permit type: from 15 to 100 € for application processing.
Degree recognition in Spain: homologación or equivalencia
Both the ministry and the head offices of employers are based in Madrid — but applications are still submitted electronically, so there is no need to travel anywhere.
One thing upfront: the word ’nostrification’ does not appear in Spanish regulations. There are two distinct procedures, and the choice affects both the timeline and the outcome:
- Homologación — applies only to regulated professions (doctor, nurse, lawyer, architect, engineer, teacher). It grants the right to practise your profession in Spain. The process is lengthy and often involves additional exams and supervised practice.
- Declaración de equivalencia — for everyone else. It equates your degree to a Spanish level and field of study. For employers outside regulated professions and for most everyday purposes, this is sufficient.
How it works now:
- the procedure is governed by Real Decreto 889/2022; applications are submitted entirely online via the Sede Electrónica of the Ministerio de Ciencia, Innovación y Universidades;
- fee — tasa 790, código 107, €166.50;
- the statutory timeframe is 6 months. In practice it takes considerably longer, especially for medical specialisations — allow a year or more;
- diplomas and transcripts from Russia, Belarus, and Ukraine are accepted only with an apostille and a certified translation (traductor jurado).
What people worry about unnecessarily: for the Digital Nomad Visa and most residence permit categories, degree recognition is not required — a diploma is either not needed at all, or the document with an apostille is sufficient. Homologación is needed for work in a regulated profession or for enrollment in a degree programme, not for legalization.
Residence permit refusal: what to do and within what timeframe
Madrid’s Extranjería office is the busiest in the country, and administrative silence (silencio administrativo) — a rejection by default — occurs here more often than anywhere else.
Key point — deadlines are strict and run from the date of notification, not from the day you found out about the refusal. There are three options:
- Recurso de reposición — 1 month, submitted to the same authority that refused (Oficina de Extranjería de Madrid). It is optional (potestativo): filing it is your right, not a prerequisite for court. A response must be given within one month; silence is deemed a refusal.
- Recurso contencioso-administrativo — 2 months, taken directly to court (Juzgados de lo Contencioso-Administrativo de Madrid). This can be filed immediately, without first filing a reposición.
- Reapplying. If a refusal is purely formal — a missing document, an expired one, or a non-sworn translation — reapplying is often faster and cheaper than any appeal.
**The mistake that can sink your case: someone files a reposición, waits six months for a response, and misses the two-month window to go to court. A reposición does not extend the court deadline indefinitely — once the one-month response period expires, the countdown for contencioso begins.
If your income falls below the threshold, an appeal in court may be covered by justicia gratuita — that is a court matter, not a residence permit application. Thresholds and conditions are covered in the lawyers in Madrid section.
Common mistakes
- Confusing NIE with TIE. NIE is a number; TIE is the physical resident card. A NIE is sufficient to open a bank account, but TIE is what proves your resident status.
- Getting Padrón without a real rental contract. Some landlords are unwilling to provide Padrón registration — clarify this before signing the lease, not after.
- Getting a translation done by a non-accredited translator. Only a jurado (sworn translator) will do — Extranjería does not accept translations from ordinary agencies.
- Ignoring document expiry dates. A criminal record certificate expires in 3 months. If the application drags on, it will need to be renewed.
- Obtaining a No Lucrativa while working on the side. This violates the terms of the residence permit and is grounds for denial at renewal. Work is only permitted through Cuenta Propia or an employment contract.
- Ignoring tax registration. After 183 days in Spain, tax residency arises automatically — you must either file an IRPF return or plan your tax strategy well in advance.
Who should choose which path
For remote workers with foreign clients — the Digital Nomad Visa via UGE in Madrid: faster and more predictable than the consular route. For the financially independent — No Lucrativa, if you have no plans to work in Spain. For entrepreneurs — Cuenta Propia, with a mandatory consultation at a gestora before submitting the business plan.
Getting legal status in Madrid is a systematic process of working through paperwork — not a one-time event. The key to success is getting your application package right the first time: Extranjería doesn’t notify you of errors, it simply rejects your application.
